Please read these Terms of Use (“Terms”) carefully before using helyxhealth.org (the “Site”), operated by Redwood Phoenix Medical Inc., d/b/a Helyx Health (“Helyx Health,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms.
1. Use of the Site
The Site provides general information about Helyx Health’s services, including psychotherapy, psychiatry, sleep medicine, and neuropsychology, offered at our physical locations and via telehealth to patients located anywhere in the state of California. Content on the Site is for informational purposes only and does not constitute medical advice, and use of the Site does not create a provider-patient relationship. A provider-patient relationship is established only after formal intake and scheduling through our clinical processes.
2. No Emergency Services
Helyx Health does not provide emergency services through this Site. If you are experiencing a medical or mental health emergency, call 911 or go to your nearest emergency room. If you are in crisis, you may also contact the 988 Suicide & Crisis Lifeline by calling or texting 988.
3. Intellectual Property
All content on the Site — including text, graphics, logos, and images — is the property of Helyx Health or its licensors and is protected by copyright and other intellectual property laws. The Site may contain links to third-party websites (e.g., insurance provider portals). We are not responsible for the content, privacy practices, or accuracy of third-party sites.
6. Disclaimer of Warranties
The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
7. Limitation of Liability
To the fullest extent permitted by law, Helyx Health and its owners, officers, employees, and providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site. Our total liability for any claim arising from your use of the Site shall not exceed one hundred dollars ($100).
Nothing in these Terms limits liability for clinical care, which is governed separately by the terms of your patient care agreement and applicable law.
8. Good Faith Estimate (No Surprises Act)
For patients who are self-pay or otherwise not using in-network insurance benefits, federal law (the No Surprises Act) entitles you to receive a Good Faith Estimate of expected charges for scheduled services. A Good Faith Estimate is available upon request; please contact us at info@helyxhealth.org to receive one, consistent with applicable law.
9. Dispute Resolution
Informal Resolution First. Before filing a claim, you agree to contact us at info@helyxhealth.org so we can attempt to resolve the dispute informally. Most concerns can be resolved this way within 30 days.
Binding Arbitration. If a dispute cannot be resolved informally, you and Helyx Health agree that it will be resolved through binding arbitration administered by the American Arbitration Association (AAA), rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
Class Action Waiver. You and Helyx Health agree that any arbitration or claim will be conducted on an individual basis only, and not as a class, collective, or representative action.
Exceptions. Nothing in this section limits either party’s right to seek injunctive relief for intellectual property infringement or unauthorized access to the Site.
This dispute resolution section does not apply to and does not limit any rights related to clinical care, patient grievances, or complaints, which follow separate clinical and regulatory processes.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Venue for any matter not subject to arbitration shall lie in San Francisco County, California.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
